**Hold Harmless - Assignment of Right of Insurance**

>> It is important to read this agreement. This agreement impacts your legal right to recovery of damages in the event of loss of life, bodily injury, property loss, property damage, claimed loss to reputation or otherwise due to your registration, presence, participation in or observation of Beyond Leather, LLC.

>> If you cannot read, and fully understand this agreement in its entirety, do not approve this document and cease all interactions with Beyond Leather, LLC. If you deny execution of this agreement your registration will be revoked and you will not be allowed to participate or observe in Beyond Leather, LLC.

* I hereby fully and forever release and discharge Beyond Leather, LLC, its owners, directors, officers, agents, employees, volunteers, any other registrant, guest or participants, or whomsoever, from any and all claims, actions, suits, injuries, damages or rights of any kind whatsoever, including without limitations, death, serious injury to body, person or reputation, in any way resulting from my registration, presence, observation, participation or activities as a registrant, guest or participant which are sustained by me regardless of negligence of the released parties.

* I understand that this release includes negligent, gross negligence and intentional acts or omissions by the released parties or any other person whomsoever in any way related to or arising during Beyond Leather, LLC events or on the dates of the event or through use or attempted use of any activities or methods.

*Beyond Leather, LLC an event that has classes, workshops and acts of artistic expression. I understand that participation in the Beyond Leather, LLC event could result in personal injuries, pain and suffering, conscious suffering, death of property damage or bodily injury and despite such dangers and risk, including Covid, death or serious bodily injury, which I may encounter, whether those risks are known, partially known, or unknown, during my presence at, observations of or participate in, whether willing or against my will, the events of Beyond Leather, LLC.

* I agree that the released parties and specifically Beyond Leather, LLC, the owners, directors, officers, agents, employees, volunteers, and any other registrant, guest or participant and the owners, operators, managers, agents, or employees of the Host Hotel and their respective successors and assigns shall have the benefit of any insurance purchased and owned by me or which includes me as a beneficiary or insured party, whether group individual or otherwise and hereby assign all rights to any payments under such policies to the released parties to cover any claims of loss, damage, injuries or otherwise arising in any way as a result of my registration, presence, observation or participation as described herein in any event or activity related to Beyond Leather, LLC or any activity released herein.

* By accepting these terms, you agree to forever release, acquit, and discharge of and from any and all manner of action and actions and waive any and all claims or liability against Hilton Hotel and their respective affiliates, and their respective current and former officers, agents, attorneys and employees (together, the “Hotel Companies”) that may arise as a result of your participation in the Beyond Leather, LLC Event (“Event”) at Hotel.

PLEASE READ THIS CAREFULLY.

* The Host Hotel does not own, control or maintain any portion of the Event or any of the equipment used in the Event. The Hotel is not responsible for any known or unknown dangers, hazards or perils associated therewith.

* In consideration for being allowed to participate in the Event at the Hotel, I hereby agree to forever release, acquit, and discharge of and from any and all manner of action and actions and waive, on my own behalf and on behalf of all persons claiming by, though, or under me, any and all claims that I have or may have against each of the Hotel Companies and their respective members, officers and directors, and against each of or any person or entity who directly or indirectly, through one or more intermediaries, controls or is controlled by, or is under common control with the Hotel Companies on account of any bodily injury (including death), serious injury to body, person or reputation, pain and suffering, conscious suffering, personal property loss, or other damages of any kind whatsoever, for negligence or otherwise, arising out of my participation in the Event.

* I will indemnify and save harmless the Hotel Companies or their respective affiliates, officers, directors, shareholders, partners, employees, members and agents from all claims, demands, penalties, liabilities, causes of action, and actions, and from any and all loss, cost and expense associated therewith or derived therefrom (including, without limitation, attorneys’ fees and paralegal fees, and disbursement through all appeals) for damages and injuries of all kinds sustained by me including, without limitation, claims for personal injury and death (negligent or intentional), or claims arising out of my negligent act(s) or omission(s), or claims that I may have against any third parties that may arise as a result of my participation in the Event.

* I represent and warrant that I am over the age of 18, fluent in and able to understand English or that I have had the opportunity to have this read and translated into a language I understand, that I am voluntarily present and of sound mind and body, not under the influence of any drugs, medications, alcohol or other substance that would impair my ability to review and fully understand the terms and conditions of this waiver and release of liability, indemnification and hold harmless agreement and assignment of right of insurance and that I agree to the terms and conditions imposed on my registration, presence, observation or participation in Beyond Leather, LLC and understand that my registration, presence observation or participation is accepted solely based on my representations and warranties and agreements or conditions contained herein.

* I have read, fully understand and agree to the “Event Rules” and the “Dungeon Rules” and agree to follow them. I have read and fully understand the foregoing waiver and release of liability, indemnification and hold harmless agreement and assignment of right of insurance and agree to its terms.

* In consideration on the representations, warranties, agreements and assumption of risks and assignment of insurance above, Beyond Leather, LLC accepts this registration.

* I understand that my electronic acceptance is legally binding, just as if I had signed a paper document. 'Electronically transmitted copies of this agreement will be fully binding and effective for all purposes whether or not documents are originally executed and transmitted.'

**Refund Policy**
Due to the nature of our events and the products and services listed, we at Beyond Leather, LLC have a strict Cancellation and Refund Policy for all products and services. Beyond Leather does not transfer registrations. Beyond Leather, LLC reserves the right to refuse any registration for any event for any reason and if that occurs, the affected customer’s payment will be refunded in full less a $30 processing fee. A customer may cancel their registration in writing at any time for any reason and Beyond Leather, LLC will refund the registration payment fee within 21 business days of receipt of written cancellation in accordance with the following:
Cancellations received on or after Nov 1 will be refunded 50%.
Cancellations received on or after Feb 1 will be refunded 25%
No Cancellations on or after Mar 1. Please do not ask for a refund!
After the registration close date, a customer’s registration may be canceled without refund or other consideration if the customer did not registered under their own legal name.
